El reconocimiento al derecho a la no discriminación por orientación sexual, identidad y expresión de género son dos derechos humanos universales que ya permanecen excluido de las propuestas de reformas constitucionales, de acuerdo con las últimas declaraciones que dio a conocer ésta semana el presidente salvadoreño, Nayib Bukele.
De la Constitución de la República actual quedarán intactos “los artículos 1, 3, 25, 26, 32, 33, 57, 58 y 65”, detalla el presidente. En el artículo 3 de la propuesta del Proyecto de Reformas Constitucionales, se establecía el principio de igualdad ante la ley, así como la prohibición a la discriminación por “orientación, identidad y expresión de género”.

“NO PROPONDREMOS cambios constitucionales que, aunque ni siquiera lo mencionaban, algunas personas dicen que podrían dejar la puerta abierta a que, en un futuro, se pueda aprobar vía nuevas leyes, el aborto, el matrimonio entre personas del mismo sexo y la eutanasia”, reiteró el presidente Bukele.

Desde los últimos 33 años, la constitución del país no ha recibido reformas, ni mucho menos cambios normativos en favor del reconocimiento de los derechos humanos de las personas LGBT. La propuesta contenida en el Proyecto de Reformas Constitucionales planteaba ser una iniciativa “progresista”. Sin embargo, organizaciones proponentes de la Comisión Ad Hoc, como la Asociación Solidaria para Impulsar el Desarrollo Humano (ASPIDH) Arcoíris Trans, sostienen avocarse a una ley secundaria que reconozca la identidad y expresión de género para persona trans.
Según lo añade la representante de la Asociación Colectivo Alejandría, Karla Guevara, una Ley de Identidad de Género “permite que personas trans puedan tener un documento de identidad que nos identifiquen”, legalmente. Este beneficio, ademas, posibilitaría a las personas transgénero y transexuales el acceso de derechos humanos básicos, como la educación, el trabajo y la salud.

“Con una ley de identidad de género, muchas ya van a poder estudiar sin miedo a que las estén discriminando y faltando el respeto en el centro de estudio. Igualmente, van a tener un poco más de confianza, al ya tener un nombre que las identifica, ir a un centro de salud, por lo mismo de que ya no van a tener temor de que las vayan a estar disciminando”, explica la representante de ASPIDH, Pamela Orellana.
La Ley de Identidad de Género ha sido la principal consigna que ha movilizado a una decena de organizaciones pertenecientes a la Mesa Permanente por una Ley de Identidad de Género, para hacer patente la propuesta en la Asamblea Legislativa. La última tentativa tuvo lugar el pasado 21 de agosto, y recibió iniciativa de ley de las diputadas del partido Frente Farabundo Martí para la Liberación Nacional (FMLN) y de Nuestro Tiempo, Anabel Belloso y Linda Funes, respectivamente.
La falta de reconocimiento del derecho al nombre por parte del Estado, implica el desconocimiento de la existencia legal de las personas trans, como consecuencia de ello otros DDHH se ven afectados.#MiNombreEsMiDerecho

Para las activistas, la ausencia de una ley secundaria que regule el cambio de nombre, sexo y género para personas trans hace de El Salvador un país que viola tratados internacionales como la Declaración Universal de los Derechos Humanos (art. 1 y 2), la Convención de los Derechos del Niño (art. 8); así como los Tratados de Yogyakarta (prn. 3) y la Opinión Consultiva OC-24/17 de la Corte Interamericana de los Derechos Humanos.
